The lessee, a natural or legal person, user of the leased property, hereinafter referred to as "The Lessee"
1. PURPOSE OF THE SEASONAL RENTAL CONTRACT
The parties hereby agree that the rental agreement is a seasonal rental, the duration of which may not exceed 90 days.
The property is not rented for use as a principal dwelling or for mixed use as a business and principal dwelling. Consequently, the respective rights and obligations of the parties (lessor and lessee) will be governed by the stipulations of the present general terms and conditions, by the modified decree of December 28, 1976, and failing that by the provisions of the French Civil Code.
2. DESCRIPTION OF THE ACCOMMODATION
The accommodation described herein is one of the LAGON PARADIS villas located at Impasse Pierrot - Dunoyer - 97190 GOSIER,
The present contract is drawn up for the villa defined at the time of reservation and signature of the rental contract.
The lessor undertakes to provide the Tenant with accommodation that complies with current regulations
3. NUMBER OF OCCUPANTS
The property is rented for a specific number of people as defined at the time of reservation and signature of the rental contract. The Tenant expressly agrees not to exceed this number without written authorization from the Owner.
4. RENTAL PERIOD
The Landlord rents the seasonal accommodation to the Tenant on the dates defined at the time of reservation and signature of the rental contract
The Tenant's arrival is scheduled from 5 p.m. on the 1st day of the rental period and departure at 10 a.m. on the last day of the rental period. (whenever possible, we will be happy to modify the arrival and departure times to suit your flight schedule)
The lease terminates automatically on expiry of the term agreed by the 2 parties at the time of booking, without the need for the lessor to give notice of termination. It cannot be extended without the prior agreement of the lessor or his representative.
Keys will be handed over in person or in a secure key box
5. RENTAL RATE AND CHARGES
The Parties have agreed to set the rent at the amount defined at the time of booking for the entire rental period described in the rental agreement.
It does not include:
〉 Tourist tax: this is set by the Gosier Town Hall, and is calculated according to the "Meublé de tourisme" star rating
- Villa Paradis and Villa Manaté rated 5 stars: €3.00 /night per person aged 18 and over
- 4-star Villa La Perle and Villa Larimar: €2.30/night per person over 18 years of age
- Kaza Datcha and Ti Kaz du Lagon rated 3 stars: €1.50 /night per person from 18 years old
〉 The maintenance/housekeeping package rate is set according to the villa defined at the time of booking
- Villa Paradis: €250.00
- Villa Manaté: €200.00
- Villa La Perle and Villa Larimar: €150.00
- Kaza Datcha: €120.00
- Ti Kaz du Lagon: €90.00
Visitor's tax and maintenance/cleaning charges are payable on arrival and are added to the total cost of the rental
6. RESERVATION
In order to proceed with the reservation of the accommodation, the Taker undertakes to make a payment of 35% of the rent at the time of reservation, and the payment of the remaining 65% in 1 or 2 instalments no later than 30 days before the start of the rental period. The instalments will be specified at the time of booking. If the reservation is made less than 30 days before arrival, the full amount of the stay must be paid at the time of booking.
The reservation becomes firm and definitive after payment of the deposit and acceptance of the general terms and conditions of sale.
7. SECURITY DEPOSIT
At the latest on arrival, the lessor will take a credit card imprint (via a secure link) as a security deposit to cover any rental damage.
The amount of the security deposit depends on the villa defined at the time of booking:
- Villa Paradis: €2,500.00
- Villa Manaté: €2,000.00
- Villa La Perle and Villa Larimar: €1,500.00
- Kaza Datcha: €1,000.00
- Ti Kaz du Lagon: €800.00
Rental damage includes all damage, stained linen (stains that don't come out) or lost linen, damage to the accommodation, as well as damage, loss of keys, remote control or theft caused to movable property in the accommodation during the rental period.
In the absence of rental damage, the security deposit will be returned to the Taker within 72 hours of departure. The Taker agrees that his bank details may be kept for this period.
A deduction from the security deposit may be made in the event of missing, broken or damaged objects, stained linen (stains that do not come out) or in the event of the return of the accommodation in a state of disarray requiring additional hours of cleaning to those normally scheduled between 2 customers.
In the event of rental damage, the security deposit will be reimbursed within a maximum period of 2 months, after deduction of any expenses incurred to repair the damage suffered, with justification and invoices. The lessee consents to his bank details being held for this period.
8. ASSIGNMENT AND SUBLETTING
The present seasonal rental contract is concluded for the sole benefit of the Tenant signatory hereto. The transfer of the lease, total or partial subletting, is strictly forbidden.
9. INVENTORY OF FIXTURES
An inventory of the furniture is available to the Tenant in the reception filing cabinet.
The inventory drawn up by the Lessor and contained in the reception file may be contested by the Tenant within 24 hours of entering the accommodation.
If the Tenant does not contest the inventory within this period, it is deemed to have been accepted without reservation.
The Tenant must inform the Lessor as soon as possible of any breakdown, damage, incident or malfunction.
The Tenant must inform the Lessor of any damage or breakages he has caused, at the latest upon his departure from the accommodation.
The Lessor may contest the inventory within 72 hours of the arrival of the next tenant. If the Lessor does not contest the inventory within 72 hours of the end of the rental period, the premises will be returned in good condition and/or with a complete inventory.
10. OBLIGATIONS OF THE LESSEE
The Tenant shall make peaceful use of the rented accommodation. He will maintain the rented accommodation and return it in a clean and tidy condition. He/she shall be liable for any damage or loss that may occur during the term of the contract in the premises of which he/she has exclusive use
He/she undertakes to make normal and reasonable use of the means of comfort (air-conditioning, water, electricity, etc.), as well as the equipment (household appliances, multimedia, kitchen, etc.) made available to him/her.
He/she undertakes to respect the number of occupants stipulated in the present contract; he/she may not include additional persons defined at the time of reservation, and may not invite outsiders without the written agreement of the Lessor
The Tenant must avoid any noise likely to disturb the neighbors, in particular that emitted by radio, television and swimming pool equipment
The Tenant must be discreet when using the swimming pool (no shouting, or swimming too early or too late to disturb the neighbors)
Parties are strictly forbidden in the accommodation
The presence of pets in the accommodation is strictly forbidden, unless expressly authorized in writing by the Lessor
To save energy, the Tenant must keep doors and windows closed when the air conditioning is on in the bedrooms, and turn off lamps and air conditioners during the day. In the event of abuse (our air conditioners are equipped with an information card), particularly the use of air conditioners during the day or with doors or windows open, a deduction from the deposit may be made.
It is forbidden to make a copy of the keys given by the Lessor.
The villa is non-smoking, and smoking is strictly FORBIDDEN inside the accommodation.
At the end of the rental period, the accommodation must be returned in a clean and tidy condition: garbage cans emptied, bathroom linen collected in the bathrooms, dishwasher emptied and crockery put away. Bed linen must be left in place on the beds. If the accommodation is returned abnormally dirty, the Tenant undertakes to pay for the additional cleaning time that the Landlord will be obliged to carry out.
End-of-stay cleaning does not include cleaning of the barbecue. The Taker must leave the barbecue clean and ash-free (not in the garden), in which case he/she will be asked to pay a €50 cleaning fee
Free Wifi access: consultation of illegal sites or downloads is prohibited, and use of the Internet connection for this purpose will result in the Tenant's details being passed on to the relevant authorities.
Failure to comply with any of the above obligations will result in a reduction in the security deposit, in proportion to the damage caused. The Tenant shall have no recourse against the Landlord in the event of theft or damage to the rented premises.
11. OBLIGATIONS OF THE LESSOR
The Lessor undertakes to maintain the leased premises in a satisfactory state of maintenance, cleanliness and safety. In the event of the failure of any appliance or equipment having a major influence on the Tenant's comfort, the Landlord undertakes to implement the means required to repair or replace it as soon as possible. The Tenant authorizes the Lessor to enter the dwelling with the contractor if necessary.
The Lessor shall not be held responsible for any nuisance outside the dwelling.
The Lessor undertakes to provide household linen (sheets, pillowcases, towels, swimming pool towels, kitchen towels) and to renew them for any stay of more than 15 days.
12. CANCELLATION
Once the deposit has been paid, the cancellation conditions set out below automatically apply. The date of cancellation or modification taken into account in calculating charges is the date of receipt of the cancellation e-mail:
- More than 60 days before arrival: 35% of the total cost of the stay is due,
- 59 to 45 days prior to arrival: 50% of the cost of the stay is due,
- from 44 to 31 days: 75% of the cost of the stay is due,
- less than 30 days: 100% of the total cost of the stay is due.
For all cancellations, a handling fee of 100 euros applies.

If the Lessor considers that the rental cannot take place under the normal conditions stipulated in the contract, due to an incident (swimming pool out of order, defective septic tank, fire, water damage, last-minute work, force majeure, etc.), the Taker's reservation will be cancelled and reimbursed in full within a maximum period of 15 days, and the Taker will not be entitled to any compensation of any kind whatsoever. The Lessor will do its utmost to help the Taker find alternative accommodation.
13. INSURANCE
The Lessor certifies that it has taken out comprehensive insurance cover for the rented property.
The Taker must provide "holiday insurance", which can be obtained from his insurance company on request, specifying the dates of the stay and the rental address: Lagon Paradis Impasse Pierrot - 97190 GOSIER
14. CANCELLATION
In the event of breach by the Tenant of any of its contractual obligations, the present lease will be terminated ipso jure. This termination will take effect after a period of 48 hours following a simple summons by registered letter or hand-delivered letter which has remained unsuccessful, and will not entitle the Tenant to any reimbursement.
15. DOMICILE
For the performance of the present contract, the Lessor and the Tenant elect domicile at their respective addresses, indicated in the heading of the present contract. However, in the event of a dispute, the court of the Lessor's domicile shall have sole jurisdiction. The present contract is subject to French law.
